Terms of Service

These Terms govern your use of Thoughtox. By creating an account or submitting a thought, you agree to them. Read them — they are short, honest, and written to be understood, not to obscure liability.

1. What Thoughtox Is (and Is Not)

Thoughtox is not a medical service.It is not therapy. It is not a substitute for professional mental health care. It is not a crisis service or a suicide prevention service. The AI-generated reflections are structured thinking prompts — not clinical assessments, diagnoses, or treatment plans. If you are in immediate danger, call your local emergency number. In India: 112. In the US: 988 or 911.

Thoughtox is a private writing and reflection tool. It lets you save entries and, if you choose, request an AI reflection on what you wrote. Nothing more.

2. Eligibility

You must be at least 16 years old to use Thoughtox. This threshold applies regardless of local minimums — given the nature of the content processed here, we have chosen the GDPR digital consent age as our global floor. If you are under 16, do not create an account.

3. Your Account

Authentication is handled via Google OAuth. You are responsible for maintaining control of the Google account you use to sign in. Thoughtox has no access to your Google password and cannot recover your account if you lose Google access.

You may have one account per person. Creating multiple accounts to circumvent usage limits or suspension decisions is prohibited.

4. Your Content

You retain full ownership of the thoughts you submit. You grant Thoughtox a limited, non-exclusive, royalty-free license to store, process, encrypt, and transmit your content solely to provide and maintain the service. This license explicitly includes:

  • Sending your text to OpenAI's API when you request an AI reflection.
  • Storing encrypted versions of your entries and any reflections attached to them.
  • Displaying your entries back to you in your history and account views.

This license does not include selling your content, sharing it with third parties for marketing, or using it to train AI models. It ends when you delete your account.

5. Acceptable Use

See the full Acceptable Use Policy. In short: Thoughtox is a private space for honest reflection, not a platform for abuse, illegal content, or automated exploitation. Submissions are screened by an automated moderation pipeline for PII, harm indicators, and prohibited content — described in detail in the AUP.

6. Free Access and Limits

Thoughtox is currently running in free-only mode. Writing entries is not capped for normal use, but AI reflection requests may be rate-limited or limited per day.

If Thoughtox later introduces paid plans, those terms will be added before paid access is offered.

7. Account Suspension and Termination

We may suspend or permanently terminate accounts that violate these Terms or the AUP. For minor or first violations we will typically warn before acting, except in cases involving prohibited content (child exploitation, direct threats, mass abuse) where termination is immediate.

When Thoughtox terminates an account for violations, your thought content and profile are deleted on the same schedule as a voluntary deletion — it is not retained as evidence or shared with third parties, unless we are legally compelled to do so.

You may delete your own account at any time from Settings. Account access ends immediately, and permanent database deletion is scheduled for 7 days later. Signing back in during that 7-day window restores the account and cancels deletion. See the Privacy Policy for exact deletion timing.

8. Service Availability

Thoughtox is provided on an as-is, as-available basis. We do not guarantee 100% uptime. Planned maintenance will be communicated in advance where possible. AI reflection may be temporarily unavailable due to upstream provider issues; your entries are still saved even when a reflection cannot be completed.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Thoughtox and its operators are not liable for indirect, incidental, consequential, or punitive damages arising from your use of the service. This includes — but is not limited to — decisions made based on AI-generated reflections, data loss due to account deletion, or service interruptions.

Our total aggregate liability for any claim arising from use of the service is limited to the amount you paid us in the 12 months preceding the claim, or ₹500 / $10, whichever is greater.

Nothing in this section limits liability for fraud, gross negligence, or death or personal injury caused by our negligence.

10. Governing Law and Disputes

These Terms are governed by the laws of India. If you have a dispute with us, we ask that you contact us first at toxthotox@gmail.com and give us 30 days to resolve it before pursuing formal action. Most issues can be resolved without escalation.

If formal resolution is required, disputes are subject to the jurisdiction of the courts of Chennai, Tamil Nadu, India.

11. Changes to These Terms

We may update these Terms. If the change is material — particularly anything affecting your content license, payment terms, or liability — we will notify you before it takes effect. Continuing to use the service after the effective date constitutes acceptance. The "Last Updated" date at the top is always current.

12. Severability

If any provision of these Terms is found unenforceable by a court of competent jurisdiction, that provision is severed and the remaining Terms continue in full effect.
